AMENDMENTS TO REG 68 FOR THE SUBSTITUTION OF LOST TITLE DEEDS SUSPENDED UNTIL FURTHER NOTICE
The Deed Registries Regulation Board has resolved to suspend the implementation of amendments to regulation 68 for the substitution of lost title deeds until further notice.
We had previously alerted our clients of the additional requirements for substituting lost title deeds applicable from 25 Feb 2019. These included :
• The affidavit had to be attested by a notary public.
• The application needed to be advertised in the Government Gazette, and lie open for inspection by the public at the Deeds Registry for 2 weeks after publication.
The Board recognised that Government Gazettes are not widely read and wants to amend to publication in a newspaper circulating in area where the property is situated.
In view of this the Board decided to suspend the implementation of the amendment until further notice.
